Implementing ECFS

The Supreme Court of Korea established the ECFS master plan in 2001, and built the electronic filing system which is the basis of the ECFS. Then, the road map for the entire procedure of civil, patent, domestic relation, administrative suit was made under the electronic litigation BPR/ISP in 2008.
The Act on the Application of Electronic Documents in the Civil Suits etc. was passed by the National Assembly on February 26, 2010, establishing the legal ground for the electronic litigation system. Thus, on April 26, 2010 , the Patent Court, which deals with intellectual property cases, adopted the ECFS for the first time in Korea. With its successful launch of the system for patent cases, a pilot program for the ECFS was implemented in the civil case on May 1, 2011, and the ECFS will be further expanded to all civil cases from January 1, 2012. In the future, all cases, except for criminal cases, will be heard through the ECFS.

ECFS registers Business Model Patent

Through the "Computerized Judicial Office System" introduced in August 2010, the ECFS registered a patent for the first time in Korean judicial history at the Patent Office. The significant content of the patent rights is the litigation management system which deals with filing, receipt, and service of various litigation papers by using computer network. Also, it provides reading and printing service of litigation records, and portal systems for electronic case filing service including the system to convert paper documents into electronic documents.
